General Terms and Conditions of LamiFIX AG
Scope
These General Terms and Conditions (hereinafter “Terms”) apply to all transactions with LamiFIX AG. LamiFIX AG reserves the right to amend these Terms at any time. The version in force at the time of ordering applies. Any differing terms and conditions of the customer are not recognised. Ordering goods or services constitutes acceptance of these Terms.
Products and prices
Prices published in our catalogue, online shop and other media are non-binding recommended retail prices, excluding VAT and shipping costs.
Prices are variable and may be adjusted daily according to quantities and market fluctuations. The current online shop price applicable to the ordered quantity at the time of dispatch is decisive for the purchase agreement. Current prices are published in the online shop; changes and errors are reserved.
Product images in advertisements, brochures, the online shop and other media are for illustration only and are not binding.
Quotations
On request, we will provide a quotation for the products you require by email or telephone.
Prices quoted are binding only if the order is placed immediately and
the agreed quantity is purchased.
Delivery times / collection
We aim to keep delivery times as short as possible. The delivery period begins when the order is placed, confirmed or released for production. Claims for compensation due to late delivery cannot be accepted. Collection can be arranged in advance.
Returns
Returns are accepted only by prior agreement. There is no general right to exchange or return goods. Custom-made goods, goods outside our stocked range and individual solutions cannot be returned. We reserve the right to deduct any costs incurred from the credit issued.
Transfer of risk
Risk passes to the customer as soon as the shipment is handed to the carrier. If dispatch is delayed or becomes impossible through no fault of LamiFIX AG, risk passes to the customer upon notification that the goods are ready for dispatch. Any individual agreement by LamiFIX AG to cover transport costs does not affect the transfer of risk.
Shipping costs
Shipping costs are charged according to the product, value of the goods and destination country.
These costs are shown at checkout.
Customer’s duty to inspect
The customer must immediately check that delivered products match the order, are complete and are undamaged. Any defects must be reported to LamiFIX AG as soon as they are discovered and no later than 7 calendar days after receipt or collection. The customer must retain the product in its delivered condition and must not use it.
For delivery by a carrier, the customer’s signature on the delivery note confirms that the product has no visible defects. Otherwise, the defect must be noted on the delivery note. This provision does not apply to hidden defects.
Warranty
We accept responsibility for goods with hidden material or design defects for 3 months after delivery. However, we reject claims for damages. We reserve the right to choose between repair and replacement. Liability is excluded for normal wear of tools or jigs, third-party modifications, improper use or repairs.
Payment terms
Our invoices are payable immediately or, by agreement, within 30 days of the invoice date. Once the payment period has expired, we reserve the right to charge default interest of 5%. Advance payment may be required for large orders or deliveries to customers not yet known to us.
Reminder and collection charges
In the event of late payment, LamiFIX AG will remind the customer by email or telephone. LamiFIX AG reserves the right to charge for reminders issued. If reminders remain unsuccessful, LamiFIX AG may assign the claim to a third-party debt collection company. That company will collect outstanding amounts in its own name and for its own account and may charge additional processing fees.
Ownership and copyright
LamiFIX® is a registered and protected trademark owned by LamiFIX AG. The LamiFIX brand name® and our images, texts and catalogues may be used by our dealers provided that such use relates to our products.

Jurisdiction and applicable law
Swiss law applies exclusively. The place of performance and jurisdiction is CH-8722 Kaltbrunn.
